In accordance with the information obligation arising from Article 13 of Regulation (EU) 2016/679 of the European Parliament and of the Council of 27 April 2016 on the protection of natural persons with regard to the processing of personal data and on the free movement of such data (GDPR), and repealing Directive 95/46/EC, ISTRAIL Sp. z o.o., with its registered office in Golub-Dobrzyń, ul. Purpose of processing:
Your personal data will be processed for the purposes of assessing submitted applications with a view to preparing for and potentially concluding an employment contract, as well as based on the legitimate interest of the Controller, such as the establishment, exercise, or defense of legal claims. The legal basis for processing is therefore Article 6(1)(b) and (f) of the GDPR. If you consent to the use of your application in future recruitment processes, the legal basis will be Article 6(1)(a) of the GDPR.
Legal basis for the data collected:
The scope of collected data is defined by Article 221 §1 and §2 of the Polish Labour Code of 26 June 1974 (Journal of Laws 2019, item 730) or, in the case of special categories of data, other applicable legal provisions (Article 9(2)(b) GDPR). If your application includes data not required by the Labour Code (e.g., photographs, information about hobbies), the legal basis will be your implied consent through action – under Article 6(1)(a) GDPR. If you provide special category data in your CV (despite not being asked to do so), we will require your explicit written consent pursuant to Article 9(2)(a) GDPR.
Recipients of your data:
Your data will not be shared with external entities except as required by law or under valid data processing agreements.
Data retention period:
- Your data will be stored for no longer than necessary for the current recruitment process and for potential legal claims (up to one month after its conclusion), or
- If you give consent* for future recruitment processes, your data may be stored for up to 6 months, or
- Until the withdrawal of such consent (in cases where consent was the legal basis for processing, e.g., for data not required under Article 221 of the Labour Code).
Data transfers:
ISTRAIL Sp. z o.o., as the data controller, does not intend to transfer your personal data to third countries or international organizations.
Automated decision-making:
Your personal data will not be subject to automated decision-making or profiling.
Data provision:
Providing your data is voluntary but necessary for the primary purpose for which the data is being collected – participation in the recruitment process.
Your rights:
You have the right to:
a) request access to your data, rectification, and lodge a complaint with the President of the Personal Data Protection Office (UODO) at ul. Stawki 2, 00-193 Warsaw, Poland.
b) subject to applicable legal provisions and in specific circumstances, you may also have the right to erasure, restriction of processing, data portability, object to processing, and withdraw your consent at any time (where consent is the legal basis for processing).
Additional information:
Please note that application documents submitted outside of open recruitment processes and those containing special category data without a valid legal basis will be immediately destroyed or returned, and the personal data therein will not be processed.
